China Addendum

Effective Date: November 1, 2021

In addition to the John Deere Enterprise Privacy Statement ("Enterprise Privacy Statement"), the following terms in this China Addendum ("China Addendum") apply to Personal Data that is collected and processed by John Deere (China) Investment Co., Ltd. ("JDCI"), John Deere Finance Leasing Co., Ltd. ("JDF"), Wirtgen China, Wirtgen (China) Machinery, and their controlled affiliates (see Exhibit 1 to this China Addendum) ("John Deere" or "We"). We collect, use and otherwise process your Personal Data in compliance with applicable Chinese laws.

This China Addendum supplements the Enterprise Privacy Statement. In case of any inconsistencies between this China Addendum and the Enterprise Privacy Statement, this China Addendum prevails.

For the purpose of this China Addendum, "Personal Data" means any electronic or otherwise recorded information related to identified or identifiable natural persons, excluding anonymized data.

1. Collection and Use of Personal Data

Collection and Use of Personal Data by JDCI

We collect and use your Personal Data in accordance with Section 1 to 3 of the Enterprise Privacy Statement.

To provide our products and services, monitor your use of machines, provide after-sale services, provide subsidies and for other necessary purposes, we may collect and use your bank account information and the GPS data of our machines, which may be considered sensitive Personal Data under applicable Chinese laws.

We only collect and use your sensitive Personal Data under the circumstances and for purposes as described above and will adopt strict security measures when processing your sensitive Personal Data.

Collection and Use of Personal Data by JDF

To provide the applicants with our financing services, process their applications, verify applicants' credit information, enter into financing agreements and related guarantee documents, we may directly collect, collect through our authorized dealers or collect through other third-party sources the following Personal Data from applicants, his/her spouses and guarantors:

Personal Data of Applicants:

  • Individual customers
    • Personal details and contact information, including name, address, phone number, photos of the applicants taken during the home visits, and ID information.
    • Financial account information, including name of the bank, bank account number, balance, and cash flow.
    • Property information, including information about the ownership of real estates and vehicles.
    • Credit reports collected from the Credit Reference Center of the People's Republic of China.
    • Public records (e.g. public government databases) related to litigations where the applicant is a party.
    • Location, usage and basic equipment data of the machine.
    • National Identification and residence registration information of the spouses of the applicants.
  • Enterprise customers
    • Information about the legal representative of enterprise customers, including his/her name, address, phone number, National Identification and residence registration information, credit report collected from the Credit Reference Center of the People's Republic of China and marriage certificate.

Personal Data of Guarantors:

  • Personal details and contact information, including name, address, phone number, photos of the guarantors taken during home visits, National Identification and residence registration information.
  • Credit report collected from the Credit Reference Center of the People's Republic of China.
  • Financial account information, including bank account number, balance and cash flow.
  • Property information, including information about the ownership of real estates and vehicles.
  • Public records (e.g. public government databases) related to litigations where the guarantor is a party.
  • Other information required in the application form.
  • National Identification and residence registration information of the spouses of the guarantors.

To evaluate the qualification of dealers, determine their line of credit and obtain certain  Personal Data of applicants and guarantors from dealers, we will also collect and use the following Personal Data from our dealers:

  • ID of the personnel designated by dealers to conduct home visits, and photos of the above personnel taken during the home visits.
  • Information about the shareholders of the dealers, including name, address, phone number, ID information, bank account number and cash flow, and real estate ownership information.
  • Information about the dealers' guarantors, including name, address, phone number, ID information, bank cash flow, real estate ownership information, photos or videos recording the signing of relevant documents.
  • Public records (e.g. public government databases) related to litigations where the dealer or its guarantor is a party.

Bank account information (including account number, balance and cash flow) may be considered sensitive Personal Data under applicable Chinese laws. We only collect and use sensitive Personal Data under the circumstances and for purposes as described above and will adopt strict security measures when processing sensitive Personal Data.

2. Sharing of Your Personal Data with Third Parties

Sharing of Personal Data by JDCI

For the purposes described in the Enterprise Privacy Statement, we may share your Personal Data with the following entities:

  • Members of the John Deere Group. We may share your Personal Data with members of John Deere Group (our global entities), where such disclosure is necessary to provide you with our services or to manage our business. A list of members belonging to the John Deere Group is available here.
  • Service providers (who will operate under our instructions set out in a written agreement with us) to assist us in providing information, products, or services to you, in conducting and managing our business, or in managing and improving our products or services. We share your Personal Data with these third parties to perform services, subject to appropriate contractual restrictions and security measures. These third parties include IT service providers who help manage our IT and back-office systems and machine services, including internet and software services: data hosting, data conversion, and cloud computing capabilities, account management and security, testing, debugging, error reporting, and usage analytics, as well as mobile telecommunication providers.
  • If applicable, at your direction, with authorized dealers so that they can support you. They may use your Personal Data in the ways set out in Section 3 of the Enterprise Privacy Statement or relating to products and services that complement our own range of products and services. These services may be subject to separate terms and conditions and privacy policies.

Sharing of Personal Data by JDF

For the purposes described in the Enterprise Privacy Statement and Section 1 of this China Addendum above, we may share Personal Data with the following entities:

  • Members of the John Deere Group. We may share Personal Data with members of John Deere Group (our global entities), where such disclosure is necessary to provide you with our services or to manage our business.
  • Dealers of JDF. We may share Personal Data to our dealers to allow them to complete government registration requirements related to our financial leasing services.
  • Service providers that provide document management, text messaging, insurance brokerage, courier, financial and other services that are necessary for the purposes as described above.
  • Financial institutions, government registration institutions (e.g. mortgage record filing institution) or regulators in the financial industry to complete the application process of our services and comply with legal requirements.

General Terms

We may share Personal Data with regulators, to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies.

If it is necessary for John Deere to transfer Personal Data in case of a merger, division, dissolution, declaration of bankruptcy, or other reasons, John Deere will notify you of the name and contact information of the recipient. The recipient shall comply with the Enterprise Privacy Statement and this China Addendum when processing Personal Data.

3. Cross-Border Transfer of Your Personal Data

John Deere is a global company, which owns entities in multiple countries and regions. As described above, in order to provide you with products and services, fulfill legal obligations or achieve other purposes provided in Section 3 and 9 of the Enterprise Privacy Statement and Section 1 of this China Addendum, we may transfer your Personal Data to our global entities or other third parties outside of China.

You agree that we can transfer your Personal Data overseas in accordance with the purposes as specified in Section 3 and 9 of the Enterprise Privacy Statement. If applicable Chinese laws require us to provide you with further notice and obtain your separate consent for the cross-border transfer, we will further provide such notice and obtain your separate consent.

We will use lawful cross-border transfer mechanisms to transfer your Personal Data overseas and adopt necessary measures to ensure the overseas recipients can provide the same level of protection as required under applicable Chinese laws.

4. Retention of Your Personal Data

John Deere will store your Personal Data for a period as described in Section 8 of the Global Privacy Statement. In case a security incident occurs, we will take remediation actions promptly and notify relevant government authorities and affected employees, when required by applicable laws.

5. Children's Personal Data

We will not offer products or services to minors under 14 years old. If you are the parent or guardian of a minor and have any question about matters related to Personal Data of the minor under your guardianship, you may contact us by means provided in this China Addendum.

6. Data Subject Rights

You have the following rights with respect to your Personal Data that John Deere collects and processes:

  • Unless otherwise provided by applicable Chinese laws, you have the right to restrict or object us to process your Personal Data. If you exercise your above right, you may not be able to use certain services or products provided by John Deere.
  • You have the right to withdraw your consent.
  • You have the right to access and request a copy of your Personal Data that John Deere collects and processes.
  • If you find that your Personal Data is inaccurate or incomplete, you have the right to request John Deere to correct or supplement.
  • Under the following circumstances, if John Deere has not deleted your Personal Data, you have the right to request us to delete your Personal Data:
    • The purpose of processing has been achieved, is impossible to be achieved, or it is no longer necessary to achieve the purpose of processing;
    • John Deere ceases the provision of products or services to you or the retention period for the Personal Data ends;
    • You have withdrawn your consent (if consent is the basis for processing);
    • John Deere processes your Personal Data in violation of applicable Chinese laws or the agreement with you.
  • You may also have the right to request us to provide you with means to transfer your Personal Data to a specific entity designated by you, to the extent that your request is allowed under applicable Chinese laws.
